1. Allgemeines
Die „Hämophilie Travel Guide“ Applikation (''App'') wird Ihnen kostenfrei von der Takeda Pharma Vertrieb GmbH & Co. KG (''Takeda''), Potsdamer Str. 125, 10783 Berlin, zur Nutzung auf Ihrem privaten mobilen Endgerät zur Verfügung gestellt.
Für Ihre Nutzung der App gelten die nachfolgenden Nutzungsbedingungen (''Nutzungsbedingungen''). Diese Nutzungsbedingungen sind ab dem Zeitpunkt. Ihrer Zustimmung auf unbestimmte Zeit geschlossen. Die Nutzungsbedingungen können jederzeit durch Sie oder Takeda ohne Angabe eines Grundes ordentlich gekündigt werden. Bitte beachten Sie, dass die Nutzung der App zusätzlichen Geschäftsbedingungen unterliegen kann, die Sie bereits gegenüber dem Betreiber der jeweiligen Plattform, über die Ihnen die App zum Download angeboten wird (z.B. Google Play oder Apple App Store), akzeptiert haben.
2. Funktionen dieser App
Die „Hämophilie Travel Guide“ App unterstützt Sie sowohl bei der Vorbereitung Ihrer Reise als auch im Urlaub vor Ort. Sie reisen immer mit Ihrem eingetragenen Behandlungsplan auf dem Smartphone. Eine Reise-Checkliste hilft Ihnen bei der Vorbereitung. Vor Ort wird Ihnen auf einer Karte das für Sie nächstgelegene Hämophilie-Behandlungszentrum angezeigt. Für sofortige Hilfe können Sie über ein direktes Symbol direkt eine voreingestellte Notfall-Kontaktperson anrufen.
Alle Daten, die Sie erfassen, werden ausschließlich lokal auf Ihrem Endgerät gespeichert und nicht weitergegeben. Mit der Exportfunktion der App können Sie ausgewählte Informationen nach eigenem Ermessen per PDF teilen.
Die App ist kein Medizinprodukt. Insbesondere analysiert die App keine der von Ihnen gespeicherten Informationen oder wertet sie in irgendeiner Form aus. Takeda erbringt mittels dieser App keine medizinischen oder ähnlichen professionellen Dienstleistungen oder Beratungsleistungen hinsichtlich Ihrer Erkrankung oder Ihrer Behandlung. Die App, einschließlich ihrer Funktionen, ist weder dazu bestimmt noch geeignet, den Rat und die Behandlung durch einen Arzt zu ersetzen oder zu ergänzen. Die mithilfe der App gespeicherten Informationen sind weder dazu geeignet noch dazu bestimmt, als ausschließliche Grundlage einer ärztlichen Entscheidung zu dienen.
3. Ihre Nutzung der App
Sie erhalten das auf die Laufzeit dieser Nutzungsbedingungen beschränkte, nicht ausschließliche, widerrufliche, nicht übertragbare, nicht unterlizenzierbare Recht zur Installation, Anzeige und Nutzung der App auf Ihrem mobilen Endgerät zu privaten Zwecken.
Die Nutzung der App richtet sich ausschließlich an Nutzer mit gewöhnlichem Aufenthaltsort in Deutschland. Sie sind ausschließlich zur persönlichen, nicht kommerziellen Nutzung für eigene Zwecke im Rahmen des vorgesehenen Leistungsumfangs der App berechtigt. Eine Nutzung für Dritte, etwa im Rahmen der Überlassung der Nutzungsmöglichkeiten oder der Bereitstellung von Diensten an Dritte, ist nicht gestattet.
4. Beendigung oder Änderung von Funktionen dieser App
Die Bereitstellung einzelner Funktionen der App steht im freien Ermessen von Takeda. Takeda behält sich vor, einzelne Funktionen der App jederzeit zu ändern, insbesondere Funktionen zu aktualisieren, zu erweitern, einzuschränken oder ganz oder teilweise einzustellen. Hierbei wird Takeda Ihre Interessen jedoch angemessen berücksichtigen. Bitte stellen Sie sicher, dass Sie die jeweils aktuelle Version der App verwenden. Sofern es Takeda zumutbar ist und dies unter Berücksichtigung Ihrer Interessen erforderlich ist, wird Takeda Sie mit angemessener Zeit vorab über die Einstellung oder Änderung etwaiger Funktionen informieren. Takeda stellt im Rahmen der technischen Möglichkeiten die ordnungsgemäße Funktion der App sicher. Fehlfunktionen (insbesondere, wenn diese einen Datenverlust zur Folge haben) führen jedoch grundsätzlich nicht zu Ansprüchen gegen Takeda, es sei denn, diese Nutzungsbedingungen bestimmen ausdrücklich etwas Abweichendes.
5. Gewährleistung
Die App, einschließlich ihrer Funktionen, wird nach dem jeweiligen Entwicklungsstand, so wie sie ist, zur Verfügung gestellt, d.h. ohne jegliche stillschweigende oder ausdrückliche Garantie hinsichtlich der Vollständigkeit, Genauigkeit oder einer bestimmten Beschaffenheit. Takeda ist nicht verantwortlich und übernimmt keine Haftung dafür, dass (i) die App Ihren Bedürfnissen und Anforderungen entspricht oder in einer bestimmten Weise verwendet werden kann oder (ii) dass alle über die App verfügbaren Inhalte korrekt, vollständig, aktuell oder zuverlässig oder jederzeit zugänglich sind.
Takeda übernimmt darüber hinaus keine Haftung für Entscheidungen von Ärzten, die diese möglicherweise auf Grundlage der App oder der von Ihnen in der App gespeicherten Informationen treffen. Die App oder bestimmte Funktionen der App können aufgrund technischer Umstände oder Zweckmäßigkeit vorübergehend nicht verfügbar sein. Sie haben daher keinen Anspruch darauf, dass die App und die angebotenen Funktionen jederzeit uneingeschränkt verfügbar sind. Sie sind allein verantwortlich für die Auswahl und Nutzung des Geräts, auf dem Sie die App uneingeschränkt verfügbar sind.

6. Haftung
Takeda haftet Ihnen gegenüber auf Schadens- und Aufwendungsersatz (i) bei Übernahme einer Garantie, einer Haftung nach dem Produkthaftungsgesetz, in Fällen des Vorsatzes, der Arglist oder der groben Fahrlässigkeit, bei Verletzung des Lebens, des Körpers oder der Gesundheit, sowie (ii) bei der Verletzung wesentlicher Vertragspflichten, das heißt solcher Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt ermöglicht und auf deren Einhaltung Sie regelmäßig vertrauen und vertrauen dürfen.
Bei einer leicht fahrlässigen Verletzung wesentlicher Vertragspflichten ist die Haftung von Takeda jedoch auf den Ersatz des vorhersehbaren, vertragstypischen Schadens beschränkt.
Im Übrigen ist die Haftung von Takeda auf Schadens- und Aufwendungsersatz, gleich aus welchem Rechtsgrund (Vertrag, unerlaubte Handlung, Verletzung von Pflichten aus dem Schuldverhältnis, Freistellung etc.), ausgeschlossen.
Für den Verlust von Daten haftet Takeda nur (i) nach Maßgabe der vorstehenden Haftungsbeschränkungen und (ii) wenn der Verlust auch durch angemessene Datensicherungsmaßnahmen (einschließlich der Datenspeicherung auf anderem Wege, z.B. durch Terminkalender, etc.) Ihrerseits nicht vermeidbar war.
7. Informationen zu den Daten
Die App sammelt keine personenbezogenen Daten. Die Informationen, die Sie in der App sammeln und speichern, werden ausschließlich auf dem Endgerät gespeichert, auf dem Sie die App verwenden. Die Informationen unterliegen daher jederzeit Ihrer eigenen Kontrolle und Verantwortung. Takeda hat keinen Zugriff auf die von der App auf Ihrem Gerät gespeicherten Daten. Mit der Exportfunktion der App können Sie ausgewählte Informationen teilweise per PDF teilen. Nur Sie entscheiden, ob und an wen Sie Ihre Daten weitergeben. Die über die App verarbeiteten Daten bestehen aus:
- Kontaktdaten Ihres Arztes oder anderer Personen, die an der Behandlung Ihrer Blutgerinnungsstörung beteiligt sind.
Über die App selbst können Sie Ihre Daten jederzeit abrufen, korrigieren und löschen. Bei Fragen zu Ihrer Privatsphäre oder zum Datenschutz kontaktieren Sie uns bitte über privacyoffice@takeda.com.
Die auf Ihrem Gerät innerhalb der App gespeicherten Daten werden durch eine Verschlüsselung vor dem Zugriff unbefugter Dritter geschützt. Wenn Sie jedoch Berichte erstellen, die auf Ihrem Gerät außerhalb der App gespeichert sind, bedenken Sie bitte, dass diese Informationen dann nicht mehr verschlüsselt sind und von jedem, der Zugriff auf Ihr Gerät hat oder/und mit dem Sie diese Information z.B. per E-Mail teilen, abgerufen werden können. Wenn Sie von Ihrem Gerät ein Back-up erstellen, enthalten die Back-ups auch diese Informationen.
Sie können die Nutzung der App jederzeit einstellen und/oder die App deinstallieren. Wenn Sie die App deinstallieren, werden auch die auf Ihrem Gerät gespeicherten App-Daten gelöscht.
8. Marken und Urheberrecht
Die Urheber- und sonstigen geistigen Eigentumsrechte für die App liegen ausschließlich bei Takeda bzw. verbundenen Unternehmen von Takeda. Jede Vervielfältigung von Elementen der App (außer in der privaten Kommunikation mit z.B. medizinischem Fachpersonal) bedarf der vorherigen Zustimmung von Takeda. Die auf dieser App angezeigten Marken, Logos und geschäftlichen Bezeichnungen (zusammen die ''Marken'') sind eingetragene sowie nicht eingetragene Marken von Takeda und anderen verbundenen Unternehmen. Soweit nicht ausdrücklich in diesen Nutzungsbedingungen vorgesehen, werden hierdurch keine Lizenzen oder sonstigen Rechte an den Marken gewährt. Die unbefugte Verwendung einer Marke kann eine Verletzung der einschlägigen Markengesetze darstellen.
9. Hinweis auf Arzneimittelnebenwirkungen
Wenn Sie Nebenwirkungen bemerken, wenden Sie sich an Ihren Arzt oder Apotheker. Dies gilt auch für Nebenwirkungen, die nicht in der Packungsbeilage angegeben sind. Wenden Sie sich an Ihren Arzt, um medizinischen Rat über Nebenwirkungen von Takeda-Produkten einzuholen. Sie werden aufgefordert, Nebenwirkungen oder Qualitätsprobleme an Takeda zu melden unter MedlnfoEMEA@takeda.com.
Wenn Sie es vorziehen, können Sie sich auch an die Gesundheitsbehörde wenden. Sie können Nebenwirkungen zu Ihrem Medikament auch direkt dem Bundesinstitut für Impfstoffe und biomedizinische Arzneimittel, PauI-Ehrlich Institut, Pau I-Ehrlich-Str. 51-59, 63225 Langen, Tel: +49 6103 77 0, Fax: +49 6103 77 1234, Website: www.pei.de, melden. Indem Sie Nebenwirkungen melden, können Sie dazu beitragen, dass mehr Informationen über die Sicherheit von Arzneimitteln zur Verfügung gestellt werden.
11. Sonstiges
Falls die App Links zu externen Webseiten enthält, sollten Sie die Datenschutzrichtlinien dieser Webseiten aufmerksam lesen, um zu erfahren, wie diese Websites Ihre Daten verwenden möchten. Auf der App verlinkte Webseiten stehen grundsätzlich nicht unter der Kontrolle von Takeda und Takeda macht sich die Inhalte nicht zu eigen. Die App richtet sich an Nutzer mit Wohnsitz in Deutschland. Takeda übernimmt keine Gewähr dafür, dass die App für Nutzer mit Wohnsitz in einem anderen Land geeignet/nutzbar ist. Die Nutzung der App und diese Nutzungsbedingungen unterliegen dem Recht der Bundesrepublik Deutschland.

1. General
The „Hämophilie Travel Guide“ application (''App'') is provided free of charge by Takeda Pharma Vertrieb GmbH & Co. KG (''Takeda''), Potsdamer Str. 125, 10783 Berlin, for use on your private mobile device.
Your use of the App is governed by the following terms of use ("Terms of Use"). These Terms of Use are effective as of the date. of your consent for an indefinite period of time. The Terms of Use may be terminated by you or Takeda at any time without cause. Please note that the use of the App may be subject to additional terms and conditions that you have already accepted to the operator of the respective platform through which the App is offered to you for download (e.g. Google Play or Apple App Store).
2. Features of this app
The „Hämophilie Travel Guide“ app supports you both in preparing your trip and on holiday on site. You always travel with your registered treatment plan on your smartphone. A travel checklist will help you prepare. On site, a map will show you the nearest haemophilia treatment center to you. For immediate assistance, you can call a preset emergency contact person directly via a direct icon.
All data you collect will only be stored locally on your device and will not be passed on. The app's export function allows you to share selected information via PDF at your own discretion.
The app is not a medical device. In particular, the app does not analyze any of the information you store or evaluate it in any way. Takeda does not provide medical or similar professional services or advice regarding your medical condition or treatment through this app. The App, including its features, is neither intended nor suitable to replace or supplement the advice and treatment provided by a doctor. The information stored through the App is neither suitable nor intended to serve as the sole basis for a medical decision.
3. Your Use of the App
You are granted the non-exclusive, revocable, non-transferable, non-sublicensable right to install, display and use the App on your mobile device for personal purposes, limited to the term of these Terms of Use.
The use of the app is aimed exclusively at users whose habitual residence is in Germany. You are only entitled to personal, non-commercial use for your own purposes within the scope of the app's intended scope of services. Use for third parties, for example in the context of the provision of the possibilities of use or the provision of services to third parties, is not permitted.
4. Termination or modification of functions of this app
The provision of individual functions of the App is at the sole discretion of Takeda. Takeda reserves the right to change individual functions of the App at any time, in particular to update, extend, limit or discontinue functions in whole or in part. However, Takeda will take your interests into account appropriately. Please make sure that you are using the latest version of the app. If it is reasonable for Takeda to do so and this is necessary considering your interests, Takeda will inform you in advance of the discontinuation or modification of any functions with a reasonable time. Takeda shall ensure the proper functioning of the App within the scope of technical possibilities. However, malfunctions (in particular if they result in loss of data) do not give rise to claims against Takeda, unless these Terms of Use expressly provide otherwise.
5. Warranty
The App, including its features, is provided on an "as is" basis, i.e. without any implied or express warranty as to completeness, accuracy or any particular quality. Takeda is not responsible and assumes no liability that (i) the App meets your needs and requirements or can be used in any particular manner, or (ii) that all content available through the App is accurate, complete, current or reliable or accessible at all times.
In addition, Takeda assumes no liability for decisions made by physicians based on the App or the information stored by you in the App. The App or certain features of the App may be temporarily unavailable due to technical circumstances or expediency. Therefore, you have no right to expect the App and the features offered to be always fully available. You are solely responsible for the selection and use of the device on which you are fully available to the App.

Takeda is not responsible for any problems you may have with your Internet Service Provider, the download platform provider, the device manufacturer or any other technical provider.
6. Liability
Takeda shall be liable to you for damages and reimbursement of expenses (i) in the event of assumption of a guarantee, liability under the Product Liability Act, in cases of intent, fraud or gross negligence, in the event of injury to life, limb or health, as well as (ii) in the event of breach of essential contractual obligations, i.e. such obligations, the fulfilment of which enables the proper execution of the contract at all and on whose compliance you can trust and trust on a regular basis.
However, in the event of a slightly negligent breach of essential contractual obligations, Takeda's liability shall be limited to compensation for foreseeable, contract-typical damage.
In all other respects, Takeda's liability for damages and expenses, regardless of the legal basis (contract, tort, breach of obligations arising from the obligation, indemnification, etc.), is excluded.
Takeda shall only be liable for loss of data (i) subject to the above limitations of liability and (ii) if the loss is also caused by appropriate data backup measures (including data storage by other means, e.g. through appointment calendars, etc.) unavoidable on their part.
7. Information about the data
The app does not collect personal or identifiable data. The information you collect and store in the App is stored exclusively on the device on which you use the App. The information is always therefore subject to your own control and responsibility. Takeda does not have access to the data stored by the App on your device. The app's export function allows you to share selected information partially as a PDF. Only you decide whether and to whom you share your data. The data processed through the App consists of:
- contact details of your doctor or anyone else involved in the treatment of your blood clotting disorder.
Via the app itself, you can access, correct, and delete your data at any time. If you have any questions about your privacy or data protection, please contact us via privacyoffice@takeda.com.
The data stored on your device within the app is protected from access by unauthorized third parties by encryption. However, if you create reports that are stored on your device outside of the app, please keep in mind that this information will no longer be encrypted and can be accessed by anyone who has access to your device and/or with whom you share this information, e.g. via email. If you create a backup of your device, the backups will also contain this information.
You can stop using the App and/or uninstall the App at any time. If you uninstall the app, the app data stored on your device will also be deleted.
8. Trademarks and Copyright
The copyright and other intellectual property rights in the App are owned exclusively by Takeda and/or Takeda affiliates. Any reproduction of elements of the App (except in private communication with, for example, medical professionals) requires the prior consent of Takeda. The trademarks, logos and trade names displayed on this App (collectively, the ''Trademarks'') are registered and unregistered trademarks of Takeda and other affiliates. Except as expressly provided in these Terms of Use, this does not grant any license or other right to the Trademarks. Unauthorized use of a trademark may constitute a violation of applicable trademark laws.
9. Indication of Adverse Drug Reactions
If you experience any side effects, contact your doctor or pharmacist. This also applies to side effects that are not specified in the leaflet. Consult your physician for medical advice about side effects of Takeda products. You will be asked to report any side effects or quality issues to Takeda at MedlnfoEMEA@takeda.com.
If you prefer, you can also contact the health authority. You can also report side effects to your medication directly to the Federal Institute for Vaccines and Biomedicines, PauI-Ehrlich Institute, Pau I-Ehrlich-Str. 51-59, 63225 Langen, Tel: +49 6103 77 0, Fax: +49 6103 77 1234, Website: www.pei.de. By reporting side effects, you can help ensure that more information is made available about the safety of medicines.
11. Miscellaneous
If the App contains links to external websites, you should carefully read the privacy policies of those websites to learn how they intend to use your information. Websites linked to the App are generally not under the control of Takeda and Takeda does not adopt the content as its own. The app is aimed at users residing in Germany. Takeda does not warrant that the App is suitable/usable for users residing in another country. The use of the App and these Terms of Use are subject to the laws of the Federal Republic of Germany.
